Taken App Terms and Conditions

Welcome to the Taken app! These Terms of Service ("Terms") govern your use of the Taken app and its related services. By accessing or using the app, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use the app.

By using the Taken app, you confirm that:

• You are at least 13 years old.
• You have the legal capacity to enter into a binding agreement.
• You will use the app in compliance with these Terms and all applicable laws.

2.1 Creating an Account

To use the Taken app, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Verification Process

You agree to participate in our rigorous verification process to confirm your identity and relationship status. Misrepresentation of your identity or relationship status may result in account suspension or termination.

2.3 Account Deactivation

You can deactivate your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful behavior.

3.1 Prohibited Activities

You agree not to:

• Use the app for any illegal, fraudulent, or unauthorized purpose.
• Harass, abuse, or harm other users.
• Upload inappropriate, offensive, or misleading content.
• Impersonate another person or entity.
• Share someone else’s personal information without their consent.
• Attempt to bypass our security measures or interfere with the app’s functionality.
• Reporting Misconduct: If you experience harassment or inappropriate behavior, report it via report@taken.dating or through the in-app reporting tool.

3.2 Respectful Communication

All interactions on the app must be respectful and consensual. Unwanted messages, spamming, or harassment will not be tolerated.

4.1 Ownership

The Taken app, including its design, logos, trademarks, and content, is the intellectual property of Taken.dating LLC. You may not use, reproduce, or distribute any part of the app without our prior written consent.

4.2 User Content

By uploading photos, messages, or other content to the app, you grant us a non-exclusive, royalty-free license to use, store, and display such content for the purpose of operating the app.

4.3 Face Data Collection & Use

By using Taken’s verification and facial recognition features, you consent to the collection and processing of facial embedding data. This data is used solely for identity verification and matching.

4.4 Storage & Deletion

Face data is stored securely and is deleted upon account deletion or upon request at support@taken.dating.

Your use of the app is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the app, you consent to the practices described in the Privacy Policy.

6.1 No Guarantees

We do not guarantee that:

• The app will always be available or error-free.
• Matches will lead to successful relationships.
• All users are who they claim to be (though we take steps to verify identities).

6.2 Risks of Online Dating

You acknowledge that online dating involves inherent risks, including but not limited to misrepresentation, fraud, or physical harm. You use the app at your own risk.

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
• Our total liability for any claims related to the app is limited to the amount you paid (if any) to use the app.

Payments & Subscriptions:

• Payments & Auto-Renewals: If you purchase a subscription, you agree to automatic renewal unless canceled before the next billing cycle. All payments are processed through Apple’s In-App Purchase system.
• Refund Policy: Subscriptions are non-refundable unless required by law. Refund requests must be submitted through Apple Support, as Taken does not manage in-app payment processing.

You agree to indemnify and hold harmless Taken.dating LLC, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the app.
• Your violation of these Terms.
• Your interactions with other users.

We reserve the right to suspend or terminate your account and access to the app at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms.
• Inappropriate or harmful behavior.
• Misuse of the app’s features.

Data Retention: After account deletion, certain data (such as messages, verification logs, or financial transactions) may be retained for up to 90 days for security and fraud prevention before permanent deletion.

These Terms are governed by and construed in accordance with the laws of the United States of America. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in the United States of America.

We may update these Terms from time to time. If significant changes are made, we will notify you via email or through the app. Continued use of the app after such changes constitutes your acceptance of the updated Terms.

Arbitration Agreement: Any disputes arising from these Terms will be resolved through binding arbitration rather than in court. Users waive the right to participate in class-action lawsuits.
